Phil Ramone dies, leaving 14-Grammy legacy with biggest stars

Phil Ramone dies: A Grammy-award winning engineer and producer, Phil Ramone worked with some of the biggest names in the music business, including Frank Sinatra, Paul McCartney, Aretha Franklin, and Ray Charles.

Ramone's son, Matt Ramone, confirmed the death. The family did not immediately release details of the death, but Matt Ramone says his father was "very loving and will be missed."

Few producers had a more spectacular and diverse career. Ramone won 14 Grammy Awards. He worked with Frank Sinatra and Aretha Franklin, Stevie Wonder and Paul McCartney, Elton John and Tony Bennett.

He produced three records that went on to win Grammys for album of the year ? Simon's "Still Crazy After All These Years," Joel's "52nd Street" and Charles' "Genius Loves Company." He was a pioneer of digital recording who produced what is regarded as the first major commercial release on compact disc, "52nd Street," which came out on CD in 1982.

He thrived producing music for television, film and the stage. He won an Emmy for a TV special about Duke Ellington, a Grammy for the soundtrack to the Broadway musical "Promises, Promises" and a Grammy for the soundtrack to "Flashdance."

Ramone made an art out of the "Duets" concept, pairing Sinatra with Bono, Luther Vandross and other younger artists, Bennett with McCartney and Barbra Streisand, and Charles with Bonnie Raitt and Van Morrison. In Ramone's memoir, "Making Records," he recalled persuading a hesitant Sinatra to re-record some of his signature songs.

"I reminded Frank that while Laurence Olivier had performed Shakespeare in his 20s, the readings he did when he was in his 60s gave them new meaning," Ramone wrote. "I spoke with conviction. 'Don't my children ? and your grandchildren ? deserve to hear the way you're interpreting your classic songs now?'"

A native of South Africa, he seemed born to make music. He had learned violin by age 3 and was trained at The Julliard School in New York. Before age 20, he had opened his own recording studio.

Tottenham beats Swansea 2-1 in Premier League

SWANSEA, Wales (AP) -Gareth Bale scored another stunning goal Saturday to give Tottenham a 2-1 win over Swansea that lifted it above Chelsea into third place in the Premier League.

Bale set up Jan Vertonghen for the first goal in the seventh minute and then curled home a brilliant effort in the 21st to double the lead.

Michu pulled Swansea back into the game with his 20th goal of the season in the 71st, but Tottenham held out over a frantic final 20 minutes to bounce back from consecutive losses against Liverpool and Fulham.

With Chelsea losing 2-1 to Southampton, Tottenham is now two points ahead of the London club in third place, but with a game more played.

"When there are so many things that go well for the team it is hard to single out individuals but Gareth is a world class player offensively and defensively," Tottenham manager Andre Villas-Boas said. "But the whole team deserve credit because coming here after two league defeats and playing the way we did is never easy."

Swansea has now lost its last three games since reaching the 40-point mark with victory over Newcastle.

Bale, who scored here for his country in midweek, produced a sublime lofted pass to catch Dwight Tiendalli out of position and play in Vertonghen.

The Belgium international brilliantly brought the ball down and slotted beyond the advancing Michel Vorm to give the visitors the lead.

Swansea should have been two goals down just six minutes later. Moussa Dembele put Emmanuel Adebayor through for the Togo striker to comfortably outpace Ashley Williams, only to fire tamely at Vorm.

But the lead was doubled in the 21st minute courtesy of a supreme finish from Bale.

Vertonghen found the forward on the edge of the Swansea box, where he took one touch before dispatching an unstoppable strike past a statuesque Vorm.

"They had a very good start but both goals showed a player of Gareth Bale's quality can make the difference," Swansea manager Michael Laudrup said. "If you take Bale out, without him the teams were at the same level."

Swansea had a spell of pressure after that, and Brad Friedel had to be alert to deny Michu after Wayne Routledge had fed him from a quick free kick after the break.

?Michu then wasted another excellent opportunity as he headed wide from the sort of chance he has made a habit of taking during his first season in English football.

But he gave the Swans hope as he found the net for the first time since the League Cup final. Substitute Ki Sung-yueng delivered a superb corner, and Michu made no mistake as he directed a header in off the far post.

EPA Proposes New Rule To Clean Up Gasoline And Reduce Smog

The Environmental Protection Agency (EPA) proposed on Friday a rule to clean up gasoline. The new lower sulfur gas is already what California uses to reduce air pollution, and the EPA wants it to be used nationwide. The agency estimates that it would save lives while adding a penny a gallon to the cost of gas. The oil industry fears it will cost more.

And I'm Robert Siegel. Today, the Environmental Protection Agency proposed a new rule to clean up gasoline. The regulation would reduce ozone and other air pollutants by close to 30 percent. That would benefit 100 million people who now live in areas that at times have unhealthful air. NPR's Richard Harris reports.

RICHARD HARRIS, BYLINE: Even though automobile emissions have improved a lot in recent decades, cars are still a major source of the compounds that create smog, so the EPA has been working on new regulations to reduce those emissions more. The main target now is to reduce sulfur in gasoline. Sulfur hampers catalytic converters, so they aren't as effective as they could be in eliminating pollution. Bill Becker, who heads the National Association of Clean Air Agencies, says this would play a critical role in helping regions meet health-based air quality standards.

BILL BECKER: We know of no other air pollution strategy that will achieve as substantial, as immediate and as cost-effective emission reductions as lowering sulfur in fuel. We can do this for less than a penny. It can be done literally overnight, and it is cost-effective compared to other strategies.

HARRIS: But the American Petroleum Institute is arguing against the new regulation saying that modifying the refineries to reduce sulfur would add 6 to 9 cents to the price of a gallon of gas. EPA rules are designed to minimize that cost by giving the industry flexibility to meet the target. California already requires gas to meet this new standard, along with Japan and the European Union. Whenever I see a well designed space, my eyes are immediately drawn to the lighting choices. No room is complete without good lighting, and a great fixture is always an element I include whenever I?m working on a makeover too. Sometimes I score a chandelier from a discount store or a home improvement store, but I?ve also splurged on good lighting when I find ?the one? ? my kitchen island pendants and bathroom sconces are the perfect example.

Great lighting is like the jewelry that makes a fabulous outfit. Your lamps, chandeliers, and sconces are an opportunity to set the style of a space, to add a layer of texture (think industrial or woven shades), or to play the role of the unexpected element. Think of crystal chandeliers in a contemporary space, a minimalist modern fixture in a more traditional room, or an industrial cage pendant in a cottage dining room.

How big should your chandelier be?? Here are the formulas:

Width of overhead chandeliers (living rooms, family rooms, bedrooms, home offices): A singular chandelier in a living space needs to be proportionate to the room size. Add the width and length of the room together in feet and convert that figure to inches to come up with the correct width of the chandelier. For example, in a room that measures 10 feet by 13 feet, add 10 + 13 together to get 23 inches in diameter.

Width of dining room chandeliers: The rule of thumb is to choose a chandelier with a diameter equal to one half the width of the table, for example, a 48 inch wide dining table should have a chandelier with a 24 inch diameter. However, many designers choose oversized pendants up to two thirds the width to make a strong style statement in a dining space (I love that look!) and modern rectangular fixtures are very dramatic over a dining room table as well.? Height: When hanging a fixture over a dining table, the bottom of the chandelier should be 30 to 34 inches above the table, low enough to create a focal point in the space, but high enough not to interfere with conversation.

Who really shot Osama bin Laden?

Despite renewed controversy over who actually killed Osama bin Laden, the one member of SEAL Team Six who could settle the whole thing -- and the man who may have actually pulled the trigger that fateful night -- may never speak out, according to new reports and a former member of the elite unit.

"You're never going to hear from him," the ex-SEAL Team Six member told ABC News. "I've spoken to him. He's just the type that doesn't care about it... [He] doesn't think he did anything special. He simply pulled the trigger when he was supposed to. That's why he'll never go public."

The al Qaeda leader was killed almost two years ago, but questions over who exactly took him down reignited this week after a pair of reports -- first out of the special operations website SOFREP.com and then from CNN national security analyst Peter Bergen -- cited anonymous SEAL Team Six members who claimed that the account of "the Shooter" featured in a recent Esquire magazine article was, to quote SOFREP's source, "complete bulls**t."

Both CNN's and SOFREP's reports cite a single anonymous SEAL Team Six member each, and both point out apparent inconsistencies in the Esquire account.

In the Esquire article, an ex-SEAL, who the magazine only calls "the Shooter," claims he and another SEAL, the "point man," were alone on the stairs heading up to the third floor of bin Laden's compound in Abbottabad, Pakistan. Before they reached the third floor, the point man saw a man poke his head out of the bedroom doorway on the third floor so the point man unleashed a few shots in his direction. The shots missed, however, and when the pair reached the third floor, the point man peeled off to tackle two women who were in the hallway -- a move meant to protect his teammates from possible suicide bombs. The Shooter, then, was the first to enter the bedroom where he came face-to-face with bin Laden, standing just inches away, and was the one who shot him three times in the head before he could get to a nearby AK-47.

That account is markedly different from the first SEAL account of the raid, as written by the pseudonymous Mark Owen in the book "No Easy Day," which came out last fall.

In Owen's account, Owen, the point man and a third SEAL -- since identified as Esquire's "the Shooter" -- all went up to the third floor together after the point man's shots from the stairway. But when they entered bin Laden's room together, they found the al Qaeda leader already down and bleeding from the head. The point man's earlier shots had apparently connected.

The two women were inside the bedroom when the point man, having deemed the downed bin Laden was not a threat, tackled them into the corner. Owen and the Shooter then fired a few more bullets into bin Laden's dying body. Only later did the SEALs realize who they had killed, Owen said.

Clouding the events further is another account written by "Black Hawk Down" author Mark Bowden called "The Finish" based on interviews with higher-level military officials up the chain of command all the way to President Obama. In that account, three SEALs ascended the steps together but bin Laden was alive and standing in the bedroom when the point man entered. The point man tackled the two women in the room and the second SEAL through the door, who Bowden did not identify, was the one that shot bin Laden first in the chest and then in the head.

Bowden's book, which was still in press when "No Easy Day" hit bookshelves, later carried an insert deferring to Owen's version of events.

Esquire Author: Claims 'Extraordinarily Speculative'

The unidentified SEALs who spoke recently to CNN and SOFREP said certain parts of Esquire's Shooter account don't add up, such as the idea the Shooter knew bin Laden was a threat because he had a weapon nearby. They said that none of the SEALs knew that an AK-47 was nearby until minutes after bin Laden was killed when they found it during a search of the compound. It was stashed above the bedroom doorway, where the Shooter would not have seen it as he entered, they said.

In addition, the Shooter's detractors claimed the men on the mission had been told to try not shoot bin Laden in the head for identification purposes, meaning the Shooter either ignored that directive when he was just feet from his target, or, in their opinion, it was more likely the point man's shots were the ones that killed bin Laden well before the SEALs knew who it was they had hit.

Phil Bronstein, the executive chairman of the Center for Investigative Reporting and author of the Esquire article, told ABC News Wednesday he "absolutely" stands by his original story and said arguments like those made by the other SEALs are "extraordinarily speculative... about what they would've done, what they shouldn't have done."

Bronstein also referred ABC News to Wednesday's statement from Esquire's Editor in Chief, David Granger, which defended the Esquire story, saying that facts of the original article had been vetted by SEAL Team Six members.

"Multiple members of SEAL Team Six confirmed the Shooter was one of those two [first on the top floor] and reported to us that it was known within the unit that the Shooter had fired the fatal shots," Granger wrote. "Other individuals briefed on the mission confirmed this to us."

A spokesperson for the U.S. Special Operations Command, which oversees the Joint Special Operations Command that launched the raid, told ABC News the command wouldn't be the one to settle the controversy anytime soon. He declined to comment on operations and said the official version of events probably wouldn't be declassified for more than two decades.

That leaves the point man, the only SEAL in the room when bin Laden breathed his last who hasn't spoken publicly, to throw his hat in the ring. And according to the CNN and SOFREP reports and the ex-SEAL with whom ABC News spoke, he's not the type to trade the special warfare shadows for the media spotlight. Not "in a million years," the CNN report said.

One thing every account does agree on is that the point man was one of the heroes of that night for risking his life to tackle the two women closest to bin Laden.

"If either woman had on a suicide vest, he probably saved our lives, but it would've cost him his," Owen wrote in "No Easy Day." "It was a selfless decision made in a split second."

"He thought he was going to absorb the blast of suicide vests; he was going to kill himself so I could get the shot. It was the most heroic thing I've ever seen," the Shooter said in Esquire.

The Secret Republican Plan to Repeal 'Obamacare'

A few minutes after the Supreme Court issued its landmark decision upholding President Obama?s health care law last summer, a senior adviser to Mitch McConnell walked into the Senate Republican leader?s office to gauge his reaction.

McConnell was clearly disappointed, and for good reason. For many conservatives, the decision was the death knell in a three-year fight to defeat reforms that epitomized everything they thought was wrong with Obama?s governing philosophy. But where some saw finality, McConnell saw opportunity ? and still does.

Sitting at his desk a stone?s throw from the Senate chamber, McConnell turned to the aide and, with characteristic directness, said: ?This decision is too cute. But I think we got something with this tax issue.?

He was referring to the court?s ruling that the heart of the 2010 Affordable Care Act, the so-called individual mandate that requires everyone in the country to buy health insurance or pay a penalty, was a tax. And while McConnell thought calling the mandate a tax was ?a rather creative way? to uphold the law, it also opened a new front in his battle to repeal it.

McConnell, a master of byzantine Senate procedure, immediately realized that, as a tax, the individual mandate would be subject to the budget reconciliation process, which exempted it from the filibuster. In other words, McConnell had just struck upon how to repeal Obamacare with a simple majority vote.

The Kentucky Republican called a handful of top aides into his office and told them, ?Figure out how to repeal this through reconciliation. I want to do this.? McConnell ordered a repeal plan ready in the event the GOP took back control of the Senate in November ? ironic considering Democrats used the same process more than two years earlier in a successful, last-shot effort to muscle the reforms into law.

In the months that followed, top GOP Senate aides held regular strategy meetings to plot a path forward. Using the reconciliation process would be complicated and contentious. Senate rules would require Republicans to demonstrate to the parliamentarian that their repeal provisions would affect spending or revenue and Democrats were sure to challenge them every step of the way. So the meetings were small and secret.

?You?re going in to make an argument. You don?t want to preview your entire argument to the other side ahead of time,? said a McConnell aide who participated in the planning. ?There was concern that all of this would leak out.?

By Election Day, Senate Republicans were ready to, as McConnell put it, ?take this monstrosity down.?

?We were prepared to do that had we had the votes to do it after the election. Well, the election didn?t turn out the way we wanted it to,? McConnell told National Journal in an interview. ?The monstrosity has ... begun to be implemented and we?re not giving up the fight.?

Indeed, when it comes to legislative strategy, McConnell plays long ball. Beginning in 2009, the Republican leader led the push to unify his colleagues against Democrats? health care plans, an effort that almost derailed Obamacare. In 2010, Republicans, helped in part by public opposition to the law, won back the House and picked up seats in the Senate. Last year, GOP presidential nominee Mitt Romney?s embrace of the individual mandate while Massachusetts governor largely neutralized what had been a potent political issue.

But, in the next two years, Republicans are looking to bring the issue back in a big way. And they?ll start by trying to brand the law as one that costs too much and is not working as promised.

Democrats will be tempted to continue to write off the incoming fire as the empty rhetoric of a party fighting old battles. But that would be a mistake. During the health care debate, the GOP?s coordinated attacks helped turn public opinion against reform. And in the past two years, no more than 45 percent of the public has viewed Obamacare favorably, according to the Kaiser Family Foundation?s tracking polls. Perhaps even more dangerous for Democrats, now-debunked myths spread by Republicans and conservative media remain lodged in the public consciousness. For instance, 40 percent of the public still believes the law includes ?death panels.?

During the legislative debate over the law, Democrats promised Obamacare would create jobs, lower health care costs, and allow people to keep their current plans if they chose to. Those vows, Republicans argue, are already being broken.

The Congressional Budget Office, the Hill?s nonpartisan scorekeeper, estimated that the health care law would reduce employment by about 800,000 workers and result in about 7 million people losing their employer-sponsored health care over a decade. The CBO also estimated that Obamacare during that period would raise health care spending by roughly $580 billion.

McConnell?s office has assembled the law?s 19,842 new regulations into a stack that is 7 feet high and wheeled around on a dolly. The prop even has it?s own Twitter account, @TheRedTapeTower.

?All you got to do is look at that high stack of regulation and you think, ?How in the world is anybody going to be able to comply with all this stuff?? ? GOP Sen. Orrin Hatch, told National Journal. ?And I?m confident that the more the American people know of the costs, the consequences, the problems with this law, then someday there are going to be some Democrats who are going to join us in taking apart some of its most egregious parts.?

In fact, just a few hours after that interview last week, 34 Democrats joined Hatch on the Senate floor to support repealing Obamacare?s medical-device tax. Though the provision passed overwhelmingly, it doesn?t have a shot at becoming law because the budget bill it was attached to is nonbinding. Still, Republicans see it as a harbinger of things to come.

?Constituent pressure is overriding the view that virtually all Democrats have had that Obamacare is sort of like the Ten Commandments, handed down and every piece of it is sacred and you can?t possibly change any of it ever,? McConnell said. ?When you see that begin to crack then you know the facade is breaking up.?

Of course, Republicans are doing their best to highlight and stoke the kind of constituent anger that would force Democrats to tweak the law. In fact, if Democrats come under enough pressure, Republicans believe they might be able to inject Obamacare into the broader entitlement-reform discussion they are planning to tie to the debt-limit debate this summer.

But that is a long shot. If Republicans hope to completely repeal the health care law, they have to start by taking back the Senate in 2014 and would likely need to win the White House two years later. Still, some Republicans think the politics are on their side.

?I?m not one of those folks who ... because I didn?t support something, I want it to be bad. I want good things for Americans. But I do think this is going to create a lot of issues and ? affect things throughout 2014 as it relates to politics,? Republican Sen. Bob Corker said. ?The outcome likely will create a better atmosphere for us.?

Republicans will need to win half a dozen seats to retake the chamber. So, what are the chances??

?There are six really good opportunities in really red states: West Virginia, North Carolina, Louisiana, Arkansas, South Dakota, and Alaska,? McConnell said last week. ?And some other places where you have open seats like Michigan and Iowa. And other states that frequently vote Republican, an example of that would be New Hampshire. So, we?re hopeful.?

And earlier this week, Democratic Sen. Tim Johnson put his home state of South Dakota in play when he announced he will not be running for reelection in 2014.

In addition to trying to win back the Senate, McConnell will have to protect his own seat in two years. McConnell has made moves to shore up his right flank to fend off conservative challengers. He?s hired fellow Kentucky Republican Sen. Rand Paul?s campaign manager, who helped Paul defeat the establishment candidate McConnell backed in the primary. ?

In the meantime, Republicans will continue to, as GOP Sen. John Barrasso put it, ?try to tear (Obamacare) apart.? And the GOP suspects it might get some help from moderate Democrats less concerned about protecting Obama?s legacy than winning reelection.

It?s just the latest act in a play that saw McConnell give more than 100 floor speeches critical of Democratic reforms and paper Capitol Hill with more 225 messaging documents in the 10 months before Obamacare?s passage. Away from the public spotlight, McConnell worked his caucus hard to convince them to unite against the law, holding a health care meeting every Wednesday afternoon. GOP aides said they could not remember a time before, or since, when a Republican leader held a weekly meeting with members that focused solely on one subject.

?What I tried to do is just guide the discussion to the point where everybody realized there wasn?t any part of this we wanted to have any ownership of,? McConnell recounted. ?That was a nine-month long discussion that finally culminated with Olympia Snowe?s decision in the fall not to support it. She was the last one they had a shot at.?

Indeed, some Republicans remember opposition forming organically as it became clearer where Democrats were headed, crediting McConnell for crystallizing the issue. Asked who unified Senate Republicans against Obamacare, Corker recalled, ?I think it happened over time.? As time moved on, it just seemed that this train was going to a place that was going to be hard to support.?

McConnell had finally won his long-fought battle to unite the conference against Obamcare. And some Republicans credit McConnell with being first to that fight.

?He had the Obama administration?s number before almost anyone else,? Hatch recalled. ?He began laying the groundwork for this fight very early, in private meetings and so forth, and really was the first one on our side in the ring, throwing punches just about how bad it was for families, businesses, and our economy.?

?There?s been no stronger fighter against this disastrous law than Mitch McConnell,? he added.

And as McConnell?s war continues, Democrats have begun positioning themselves for the next battle. Leading up to last week?s three-year anniversary of the law?s passage, Democrats held press events touting its benefits, claiming more than 100 million people have received free preventive services; 17 million children with preexisting conditions have been protected from being denied coverage; and 6.6 million young adults under 26 have been covered by their parents' plan.

Democrats wisely rolled out many of the easiest, most-popular Obamacare benefits first. The next few years will see the implementation of provisions that are both more complicated and controversial, like creating state-based insurance exchanges where people can buy coverage. Asked about the political ramifications of possible implementation problems, Democratic Sen. Max Baucus, a chief architect of Obamacare, sidestepped the question saying, "My job is to do my best to make sure this statute works to help provide health care for people at the lowest possible cost."

Far from a full-throated assurance that everything will run smoothly, Baucus?s answer hints at the dangers Democrats face as Obamacare comes online.

And with the law moving from the largely theoretical to the demonstrable, the health care debate is poised to return to intensity levels not seen since before the law passed.

For congressional Republicans, it?s probably their last, best chance to turn opposition into political gain.

And much of that job falls to McConnell, a brilliant defensive coordinator who will have to play flawless offense if he hopes to take control of the Senate next year.

We've reached one of those crossroads in which we've got all sorts of things to talk about, but not a whole lot to show for it, and it's as frustrating for us as as writers as it is for you as readers.

We could go on all day about the HTC One. (And, no, we're not done poring over it just yet, so expect a few more features this week.) We could talk till the cows come home about the Galaxy S4. But the fact of the matter is -- at least for those of us here in the States -- you can't actually buy one yet. Europe's getting the HTC One this week. We've still got a month (more or less) before the Galaxy S4 goes on sale anywhere -- and remember that we have no hard and firm dates from any U.S. operators yet. 

Point is, this job is so much more fun (and easier, too), when we all have our hands in the honey pot, getting sticky together. (Ed. Note: Ewwwww. Gross. Ed. Note 2: You just put an editor's note in a first-person editor's column. What the hell, Phil?) Here's to hoping we all get sexy slabs of aluminum and plastic sooner rather than later.

OK, I do have one new phone on my desk this week that anyone else can have, too. I bought my first BlackBerry.

Gunman opens fire with assault rifle outside fast-food restaurant; 1 dead

SAN DIEGO -- A man was fatally shot at close range by a semi-automatic assault rifle Saturday evening outside a fast-food restaurant, authorities confirmed.

The shooting happened at around 5:30 p.m. PT (8:30 a.m. ET) ?in the parking lot of a Carls' Jr. on Sweetwater Road in National City, Calif. The gunman fled the scene after fatally injuring a male victim.

The victim was shot approximately 10 times from a distance of about 10 to 15 feet, according to Lt. Robert Rounds. When police arrived, the victim was lying on the ground in critical condition.

He was transported to UCSD Medical Center, but died a short time later.

Police immediately began searching the area for the suspect, who fled the parking lot in a white 1970s Ford pickup truck with an orange stripe on it.

Investigators roped off the parking lot in the Sweetwater Town and Country Shopping Center with crime scene tape as they searched the area for bullet casings.

Witnesses Muhammed Camran and Michael Ybarra told NBC 7 San Diego that they were right across the street at the time of the shooting, playing golf at a nearby golf course.

The sudden sounds of gunfire shocked both of them.

?We were over here at the golf course just hitting some balls and we hear a loud ?boom.? The first one was really distinctive like ?boom-boom-boom-boom? and we kind of ducked because it was out of nowhere,? recalled Camran.

Meanwhile, witness Trevor Hermann was working at Pet Mart, less than 200 yards from the scene of the deadly shooting.

?I was helping a customer, looking at dog food, and then all of a sudden we heard all of the gunshot. Then I went out and thought it could have been someone's backfire from a truck, but I didn?t think that much, and then I looked further away and there was a guy just lying there,? he explained.

Hermann said he saw the suspect speeding away in an orange and white truck that drove right past his storefront.

?It had a little bit of speed on it and it went away a little quick, and that?s how I knew it was that truck that did the shooting,? he added.

Police say witnesses describe the suspect as a Hispanic male wearing a black-hooded sweatshirt. He was last seen driving east on Sweetwater Road in the distinctive truck.

The shooting victim's name has not yet been released. A report from the county Medical Examiner's office confirms the man was a 43-year-old National City resident.

1 in 600 may be owed unclaimed life insurance money

According to a recent study in Consumer Reports, there's a one-in-600 chance that you're owed unclaimed life insurance money. NBC's John Yang reports.

NEW YORK -- Andy and Christina Fox, retirees living in Maryland, were shocked when they received a letter in late 2011 from a small life insurance company in the Midwest.

"To be honest with you, we thought it was a scam," Chris says. "It was five years after my father had passed. We had no knowledge of any insurance policies whatsoever."

It was no scam. It turned out that Chris's father -- an airplane mechanic and pilot -- had left thousands of dollars in a life insurance policy and never told his family.

"Final request," the letter announced. According to law, the money would soon be considered abandoned and turned over to state authorities.

How to find unclaimed life insurance benefits

Chris never knew the money existed because her mother had been named in the policy. But Chris's mother had since died, too, and Chris had sold her parents' Missouri home. Earlier notifications slipped through the cracks until the final request found its way to Maryland.

The letter set the Foxes off on a journey. To recover the policy, they hired a lawyer to create an estate for Chris's mother. They made countless phone calls. Scouring a Missouri unclaimed property database, Chris learned there was even more money out there. In sum, her father had taken out three life insurance policies, worth about $48,000 total.

"You had to look at the generation that he came out of. You're talking about the depression," Chris says. "People that didn't have any money at all didn't put it one particular place. They took small bits and put it in several different places."

The Foxes' experience isn't unique. According to a recent study in Consumer Reports, there's a one-in-600 chance that you're owed unclaimed life insurance money. Those are better odds than winning $100 on a Powerball ticket.


"The average benefit that's waiting to be collected is only about $2,000. But some of them are up to $300,000," says Jeff Blyskal, a senior editor at Consumer Reports and the author of the study. According to Consumer Reports, the total amount of unclaimed life insurance money nationwide is upwards of $1 billion.

The breadth of the problem has come to the attention of authorities, too.

Regulators set up a multi-state task-force in 2011, and last year major life insurance companies began paying millions of dollars in settlement fees and back benefits. The money, flowing into state unclaimed property offices across the country, comes after officials said that companies regularly delay finding beneficiaries of unclaimed money.

In January, New York Gov. Andrew Cuomo announced that more than $200 million had been collected for beneficiaries in his state. Florida, which led the multi-state investigation, has collected at least $51 million in back benefits -- and hundreds of millions of dollars more in fines. Other states that have collected money include California, Illinois, New Hampshire, and Pennsylvania.

"When Floridians put their family's needs in another's hands, they have a right to know their company will deliver on its promises and be transparent in its dealings," Florida's insurance commissioner, Kevin McCarty said in a statement.

Jeff Blyskal, Consumer Reports Senior Editor, on the life insurance money many American families don't know is waiting for them. 

As a result of the settlements, companies have agreed to perform regular checks against the so-called Death Master File -- the electronic record the federal government uses to track Social Security recipients.

Among the companies that have reached settlements:

-- AIG reached an $11 million settlement with multiple states and has paid more than $100 million to beneficiaries who had not previously filed a claim;

-- Nationwide reached a $7.2 million settlement and has paid about $144 million to beneficiaries;

-- and MetLife paid $40 million in settlement money, and tells NBC News it is "on track with... remitting policy proceeds" to beneficiaries.

But critics say the life insurance industry should do even more.

"If the insurance company, or any company, wants to find you to collect a bill, for example, they have a pretty easy time doing it, through the credit bureaus and such," says Jeff Blyskal of Consumer Reports. "If they can find you to pay a bill, they can find you to pay you your life insurance benefit."

The American Council of Life Insurers, an industry group, says companies are adapting to shifts in technology, including the government's electronic records.

According to the group, there are 150 million life insurance policies in force across the country. Last year alone, the group says, the industry paid a total of $62 billion dollars in claims.

"While the amount of unclaimed life insurance benefits at issue represents a very small percentage of total claims paid, we know the percentages represent real people," the group said in a statement.

Mary Jo Hudson, a spokeswoman for the group, added during an interview that it's not uncommon for months to pass before companies hear from beneficiaries. ?Within a reasonable amount of time -- 18 months -- people would make a claim, so we would wait," Hudson said. "Often, people don't file a claim right after someone is deceased because of grieving issues."

Now, regulators are looking to draft model legislation that would require all life insurance companies to locate and pay beneficiaries faster.

Meanwhile, both critics and representatives of the life insurance industry agree that it's vital for policy holders to discuss their plans with family and loved ones.

"One of the problems with this whole issue is that it involves death, and people don't like to talk about death," Jeff Blyskal says.? "But you really should. As you're getting older, if you have a life insurance policy, you should let your family know about what they're entitled to."

ACLI, the industry group, is offering a free website it hopes will makes such conversations easier, where users can put information in one place and share it with family and loved ones.

After the Foxes collected their money, they distributed it evenly among Chris's sisters. Chris and Andy Fox kept $16,000.

"I took my share, and hopefully invested it wisely," Chris says. "We'll use that to send my grandchildren to college."

Satisfaction studies can sound like broken records, with familiar leaders and positions that don't move. Not so with J.D. Power's first smartphone survey for 2013. While Apple maintained the top spot for the ninth time in a row through US customers' happiness with the hardware design and ease of use, most of its major competitors made big strides in reliability, speed and camera quality in the past half-year -- to the point where there was a virtual dead heat for second place between HTC, Motorola, Nokia and Samsung. They lifted the average by about 22 points and left only LG (which has few high-end US phones) and a pre-transition BlackBerry lagging behind. We wouldn't be surprised to see an improvement for those last two by the September study.

Whatever your platform preference, J.D. Power has found some shared experiences. Bugs are still a problem on phones when about 17 percent of those asked ran into some kind of glitch. However, it's clear that those who lean heavily on their smartphones tend to love them: survey takers who used social networking apps for 100-plus minutes a week were significantly more likely to recommend whatever they had. That might help explain a high conversion rate among basic phone owners, where three quarters of those planning to update their devices expected to move to a smartphone.

Genetic evidence that new therapies targeting Parkinson's disease may cause harm

Mar. 20, 2013 ? NorthShore University HealthSystem (NorthShore) and Mayo Clinic researchers have partnered on a study that shows genetic and clinical evidence that therapies targeting the expression of alpha-synuclein -- a gene whose function is involved in the development and progression of Parkinson's disease -- may accelerate disease progression and increase the risk of physical incapacitation and dementia. If replicated, the findings will have profound implications for therapies under development for Parkinson's disease.

"Our research suggests therapies that seek to suppress alpha-synuclein in Parkinson's disease may actually accelerate the disease process and increase the risk for developing severe physical disability and dementia," says lead author Demetrius Maraganore, M.D., Ruth Cain Ruggles Chairman, Department of Neurology at NorthShore. "We believe it is our responsibility to release these data because this type of treatment may have long-term harmful effects."

Alpha-synuclein is a major component of Lewy bodies -- a characteristic brain cell abnormality that occurs in all cases of Parkinson's disease. Since its discovery as a cause of familial Parkinson's disease nearly 20 years ago, alpha-synuclein has been the focus of intensive efforts by researchers working to definitively characterize the protein's role in idiopathic Parkinson's disease and its potential as a target for neuroprotective therapies. It has also been the focus of multiple efforts to develop a molecule that suppresses the protein function. A vaccine that targets alpha-synuclein (reducing alpha-synuclein levels) is currently in Phase I clinical trials, and a number of molecules that target the protein for reduction are in advanced stages of preclinical development.

"For the first time we observed that while over-expression of alpha-synuclein increases the risk for developing Parkinson's disease, conversely, under-expression is associated with worse motor and cognitive outcomes after the disease starts," says first author Katerina Markopoulou, M.D., Ph.D., a neurologist at NorthShore. "This raises concerns about the efficacy and safety of therapies designed to reduce alpha-synuclein expression in Parkinson's disease."

The researchers followed 1,098 Mayo Clinic patients for nearly 15 years (median: eight years), and sequenced the patients' DNA to determine the presence of gene variants that regulate how much alpha-synuclein protein is made. They studied the association of these gene variants with patients' survival that was free of severe motor and cognitive disabilities. Patient outcomes were measured by telephone interviews.

The scientists found that patients who had the reduced expression genotype had a 23 percent greater risk of becoming wheelchair-dependent or developing dementia.

"This is the first large genetic association study of alpha-synuclein and longitudinal outcomes in Parkinson's disease," says Eric Ahlskog, M.D., Ph.D., a Mayo Clinic neurologist and author on the study. "If replicated, this research may change the treatment paradigm focused on alpha-synuclein reduction for Parkinson's disease."

The study will be discussed at 5 p.m. EST, March 20 at the 2013 American Academy of Neurology (AAN) Annual Meeting in San Diego. This research is one example of the collaborative efforts between NorthShore and Mayo Clinic under the Mayo Clinic Care Network, a unique partnership that provides NorthShore patients with access to medical resources and experts from both systems working together on their behalf.

Hayat Dissent: Anticipatory Prosecution, Court's Rulings Unjust ...

Last week, the Ninth Circuit upheld the conviction of Hamid Hayat, a man with a seventh-grade education who confessed to attending a terrorist training camp after intense interrogation. His statements were corroborated by the testimony of a paid informant, with credibility issues, and the testimony of an expert who stated that the prayer in Hayat?s wallet would only be carried by a ?jihadist.?

He was convicted of providing material support to terrorists, or as the government put it, having a ?jihadi heart? and a ?jihadi mind.? The majority upheld the conviction, while a passionate Judge Tashima issued a twenty-five page dissent.

"[T]he government has concluded that it is not for it to say what offense Hamid Hayat has committed, but it is satisfied that he committed some offense, for which he should be punished."

Anticipatory prosecution is now one of the government's anti-terrorism strategies. In these cases, individuals are prosecuted based on fear of future acts -- not on past behavior. Often, fear is substantiated by a plan, realistic or not. Hayat had no plan - only the unsubstantiated mutterings of an uneducated man who professed agreement with the despicable acts of the Taliban.

"I never intended on going to a camp."

We previously bemoaned the majority's emphasis grammatical semantics, and while that statement doesn't exhaustively assert "I did not and do not, in the past, present, or future, plan to attend a camp" is it fair to require that level of grammatical perfection of a man with limited education who was raised, in large part, in Pakistan?

Tashima's dissent argues the statement should have been admissible as a state-of-mind exception to the hearsay rule, especially in the context of Hayat's ongoing dialogue with the informant. The informant badgered him repeatedly about not going to a camp. He responded with the above statement.

In that context, the grammatical semantics seem even more meaningless.

Truth be told, Hayat seems like an uneducated blowhard. He tried to impress his new friend, who continued to encourage him to make increasingly extreme statements. When it came time for trial, the court allowed inculpatory statements while keeping out the statement that could have cast doubt on his "jihadist" intent.

The Rules of Evidence prohibit an expert from making an inference about whether the defendant possesses the requisite mental state. So why was the expert's testimony allowed here?

In Younger, an expert testified that someone possessing massive amounts of drugs usually does so for purposes of dealing. That was proper because the jury was free to conclude that the defendant was atypical.

While experts are free to testify to general practices or motus operandi, they cannot make categorical, definitive statements. According to the dissent, this testimony seems to have gone a step too far.
